The fundamental reason this classification exists is to provide technical legal and clerical work for the Municipal Court in the issuing and recording of warrants, subpoenas, affidavits and petitions, conditional ! forfeiture, appeal bonds, and other legal documents and in the setting and granting of bail. The essential functions of the class are: sets appropriate amount of cash or property bonds; creates and access court files and records; processes and/or issues legal and non-legal documents; hears complaints and asks appropriate questions to make probable cause determinations; responds to telephone inquiries; reschedules court dates for misdemeanor or traffic cases; processes bail received for individuals. Employees are supervised by the Senior Magistrate and work with considerable independence, but are advised to consult with higher level court personnel on complex complaints. Work is reviewed for conformity with legal procedures and points of law by other Magistrates, Senior Magistrate and/or the Court Administrator. ESSENTIAL FUNCTION: Sets appropriate amount of cash bond or property bonds using a bond schedule and tax assessment sheet, and based on the class of felony or misdemeanor and issues or processes bonds or bail using department forms, and calculator.
Enters information on appropriate forms.
Collects bonds and full payments per department procedures.
Calculates total amounts of cash bond, property bonds or mandatory paym! ent in full.
ESSENTIAL FUNCTION: Creates and access court files and records using courts computer system, jail transcripts, warrant information, and traffic citations following department procedures and federal, state, and municipal laws and ordinances in order to ensure accessibility and accurateness of records and files.
Creates electronic files by initiating warrant process for defendants.
Enters legal or court documents in the appropriate location.
Enters traffic citations into a computer in order to keep current records of citations written by the Montgomery Police Department.
Takes verbal oaths from law enforcement officials to verify the truthfulness of information contained in the traffic citation.
Verifies the validity of the traffic citation by subscribing in the appropriate section.
ESSENTIAL FUNCTION: Processes and/or issues legal and non-legal documents to include subpoenas, conditional forfeitures, appea! l bonds, etc. per department procedures using court dockets, case files! , and computer in order to have papers served in a timely manner.
Checks court docket against case files returned from court to ensure all subpoenas and
conditional forfeitures are accounted for by matching the names, dates and case numbers of case files with the docket.
Enters documents such as subpoenas, conditional forfeitures, appeal bonds or other legal documents on appropriate forms as indicated by the court docket.
Prepares documents for certified mail or for serving by law enforcement officials.
Enters documents in the appropriate case file.
Checks addresses of defendants for accuracy on unserved subpoenas.
Indicates the date documents are served in the docket entry of each case.
ESSENTIAL FUNCTION: Hears complaints from citizens and law enforcement officer and asks appropriate questions in order to make probable cause determinations, and to determine whether the complaint is a criminal or civil matter and issues misd! emeanor or felony warrants, affidavits and summons or juvenile petitions as authorized by and according to city or state statutes, ordinances, codes, etc.
Conducts conditions of release hearings with defendants on cases involving domestic violence or any cases deemed necessary.
Conducts interviews and takes depositions and affidavits from citizens and law enforcement officials to obtain pertinent facts in order to make probable cause determinations.
Refers citizen or law enforcement officials to appropriate division, authority or agency for civil matters or for matters in which a warrant, petition or affidavit and summons is not issued.
Recommends possible solutions to potentially life-threatening or volatile situations to include domestic disputes.
Determines the appropriate criminal charge for each complaint heard based on a knowledge and understanding of the law and on information provided by citizens or law enforcement officials.
Reviews wri! tten depositions and affidavits for accuracy and completeness and swear! s complainants to their truthfulness.
Enters warrants, affidavits and summons or juvenile petition forms and wanted person cards by filling in the appropriate information to include citing the pertinent section of the code using the sworn affidavit or deposition.
Records warrants issued by entering the appropriate information into the docket entry of each case to include the warrant number, defendant's name, complainant's name, charge and date served.
Forwards warrants to appropriate department or law enforcement personnel to be served.
Prepares "Advice of Rights" form for defendants and verbally advises them of their rights and the charges against them using a court transcript, and secures signatures on the form and scans the document into computer software.
ESSENTIAL FUNCTION: Responds to telephone inquiries from citizens or law enforcement officials, bonding companies, etc. regarding trial or plea dates, warrants, subpoenas, capias warrant! s, court procedures or proceedings, bail or bonds, conditional forfeitures, etc.
Reviews information from computer case files.
Relays information as requested to citizens or law enforcement officials related to parking fines, warrants, subpoenas, trial or plea dates, etc.
Checks computer case files for capias or outstanding warrants as requested by law enforcement officials or citizens by pulling up information on computer files and by physically reviewing and checking documents.
ESSENTIAL FUNCTION: Reschedules court dates for misdemeanor or traffic cases which are set over by the court or by attorneys using computer and court dockets and calendars in order to effectively reschedule individuals for court.
Resets court date for cases set over by the court or by attorneys by checking court calendars and personnel listings, setting new dates with attorneys and entering information related to the case on the court calendar and/or on the! computer.
Contacts appropriate parties to advise of new schedule. !
Checks appropriate calendars, dockets, or schedules for openings.
Re-issues subpoenas to appropriate parties by entering the appropriate information to include new court dates on the subpoena form and preparing for certified mail or for serving.
ESSENTIAL FUNCTION: Processes bail received for individuals detained for capias or alias warrants using calculator and case files following policies and procedures in order to provide detainees with options to be released from jail.
Reviews computer case files to determine the types of warrants an individual has and the fines that are associated with the offense.
Calculates pay out based on outstanding fines.
Calculates bail and determines whether the bail must be cash only or can be done on property bail, bond, or cash basis.
Computes pay out or bail form for individual in order to provide that person with options for being released. Knowledge, Skills and Abilities Knowledge of computer ! data entry procedures as needed to update or retrieve information related to misdemeanor, felony or traffic offenses.
Knowledge of court proceedings or procedures and of legal terminology as used on legal documents in order to issue warrants, affidavits and summons, juvenile petitions, subpoenas, conditional forfeitures, bonds, appeal bonds, etc. to respond to questions from citizens, court personnel, law enforcement officials, etc.
Knowledge of city or state criminal codes, statutes or ordinances as it relates to affidavits and summons, juvenile petitions, misdemeanor or felony criminal offenses or traffic offenses.
Ability to research/locate legal or court documents to include codes or regulations or ordinances as needed to research laws or to process warrants, juvenile petitions, affidavits and summons.
Ability to deal tactfully with citizens from all socio-economic backgrounds and educational levels.
Ability to maintain patie! nce and composure while dealing with emotional, upset or angry citizens! .
Ability to listen to angry, emotional or upset citizens as needed to determine the pertinent facts and to analyze information obtained from the interview.
Ability to analyze pertinent information obtained from interviews and to arrive at logical conclusions as it relates to issuing warrants, affidavits and summons or juvenile petitions.
Ability to write effectively as needed to draft warrants, affidavits and summons or juvenile petitions in accordance with accepted department and court procedures and requirements.

Ability to read and comprehend court or legal documents to include criminal or building codes such as the Alabama Criminal Code Annotated, Criminal Code of the State of Alabama, the Code of the City of Montgomery, Building Codes, Standard Fire Codes, etc. as needed to obtain information related to complaints and to process warrants, affidavits and summons.
Skill at entering and retrieving information on computer files using a computer terminal.
Skill at typing with accuracy in order to produce legal and non-legal documents, forms, etc.
Skill in ! using general office equipment such as keyboards, calculator, and copie! r as needed to process warrants, bonds, case files, etc.
Skill in using metal detector as needed to ensure the safety of individuals in the offices of the court. Minimum Qualifications Bachelor's degree in criminal justice or a related field; or four years of experience making decisions related to issuing warrants or law enforcement making arrests, or an equivalent combination of education and experience. Special Requirements Must be willing to work rotating shift work, holidays and weekends as required or needed and to work an eight hour shift without lengthy breaks at locations designated by the Municipal Court management. Overtime shift work maybe required as needed to accomplish department objectives. Upon employment, applicants must enroll in and successfully complete the Alabama Municipal Court Magistrates' Certification Program as required by the Municipal Courts Administrator within the first two years and must attend yearly maintenance courses or any other! requirements issued by the Alabama Office of the Courts as required to maintain certification.
