About the Position:
Works under the general administrative supervision of the District Counsel, with full authority to function independently as Deputy District Counsel and as the Principal Assistant District Counsel in charge of procurement law.

Serves as Deputy District Counsel. Exercises full and concurrent
authority with the District Counsel in the planning, supervision, management,
direction and review of all policies, programs, and operations involving the
functions of the Office of Counsel! . Directly supervises attorneys involved in a
wide variety! of specialized fields of law. Personal contacts are maintained
with agency higher echelons, state and federal courts and administrative
forums, and state and other federal agencies. In the absence of the District
Counsel, is fully responsible for the functioning of the office. Relieves the
District Counsel of the day-to-day details of supervision, administration,
direction, and decision making in technical and policy matters involving the
application of established guidelines and thus assures that the District
Counsel is afforded maximum opportunity for the accomplishment of long range
planning, liaison with the District Engineer, his staff and with higher
echelons. Exercises technical and administrative supervision over 15 to 17 employees
in varied professional, technical, administrative, and clerical positions.
Performs long and short range planning, assigns work and balances workload
among subordinate attorneys, evaluates ! performance of subordinates, interviews
applicants, makes recommendations for the selection of vacancies, determines
training needs and incentive awards, recommends disciplinary actions, approves
leave and manages position classification by conducting biennial position
review. Exercises responsibility to assure implementation and operation of
District, Division, USACE and DA policies, regulations, and guidelines
concerning equal employment opportunity for minority groups and women. Serves as the Principal Senior Assistant District
Counsel in charge of all procurement related matters as the program manager,
rendering legal advice on the most difficult issues involving contract
formation, fiscal law, contract interpretations, terminations for default or
convenience, suspensions and debarments, warranty enforcement, and
unsatisfactory performance ratings. Manages, reviews, analyzes, and provides
legal advice on contract claims an! d appeals and prepares contracting officer's
decisions. Manages the! procurement functional area for timely processing
standards; exercises professional oversight of work product, claims, appeals,
and acquisition strategy of other OC attorneys assigned contract reviews,
contract formation opinions, bid and award protests and contract claims.
Maintains a close and personal involvement in the unique and complex South and
Central American issues, from a procurement and contract formation perspective,
which requires responsive and prioritized legal attention and involves the
applicability and propriety of foreign nation sales taxes imposed on contractors;
interpretation of treaties and diplomatic memorandums; analysis of source
selection plans for the evaluation of technical capabilities of contract
proposals; bonding and surety document issues; and legal concerns, policy and
precedent involving security problems occasioned by foreign forces, civil
disturbances and strikes. International legal iss! ues involve sensitive
inter- face with COE higher echelons, Department of State Officials, Office of
the Army Judge Advocate General, representatives of foreign Governments, and
other federal agencies. Serves as the District's principal courtroom advocate
and shares with the District Counsel program responsibility for managing all
litigation (including Type I, II and III cases) in the federal court system
including civil litigation, contract claims and appeals, and bid protests, in
cases brought by and filed against the Government. Civil litigation cases
include those sounding in tort, contract, admiralty, labor and personnel,
environmental and regulatory, trespass and all other designated actions.
Incumbent must have a comprehensive knowledge of a wide variety of specialized
fields of law and federal regulations.

QUALIFICATIONS REQUIRED:
Applicants will be evaluated to determine if they meet the minimum qualif! ication requirements and the extent to which their application shows po! ssession of the following specialized experience associated with the position.

Experience regarding federal laws, regulations, policies and procedures related to the organization's missions and programs, civil works, military, and support for others programs (or equivalent program), including: authorities, appropriations, federal acquisitions (acquisitions (architect-engineering and construction contracts for their equivalent such as major systems development, R & D, information technology, utility services and/or Federal Supply Schedule contracts), contract administration disputes and litigation, and environmental law compliance, regulations and remediation.

Experience in the followings areas of federal laws and practices: litigation administrative, standards of conduct, ethics, civilian personnel and employment, labor-management relations, fiscal, real estate, admiralty torts, and constitutional.

Experience to manage the organization's highly di! verse legal services program (including oversight and managing, mentoring, training, and motivating legal office staff)

Experience to balance national (external) and organizational (internal) program goals and priorities; to review program implementation and results; to develop and utilize innovative approaches in solving problems and issues; to function as senior counselor and advisor to the Commander; to work effectively with other military and other senior management officials within the U.S. Army Corps of Engineers, with other governments entities and with private parties.

Ability to communicate effectively orally and in writing.

VETERANS PREFERENCE INFORMATION : There is no formal rating system or applying veteran's preference to attorney appointments in the excepted; however, the Department of the Army considers veteran's preference eligibility a positive factor for attorney hiring. Time in Grade Requirement : If currently employed as an attorney by the federal government you must have completed one year of time-in-grade at the next lower grade level within 30 days of closing date of the announcement, or previously served at the same or higher grade as the position filled.

Education: An applicant must have successfully completed a full course of study in a school of law accredited by the American Bar Association (ABA) and have the first professional law degree (LLB or JD).

Bar Membership: An applicant must currently be member in good standing of the bar of a state, territory of the United States, District of Columbia, or Commonwealth of Puerto Rico.

Applicant must have two or more years of professional legal experience, acquired after being admitted to the bar, commensurate with the duties and responsibilities of the position. Graduation from an ABA-Accredited Law School in the top 25% of the class or an advanced law degree such as an LLM may substitute for one year of the required professional legal experience.
